Welcome to Allby. These Terms of Use ("Terms") are the agreement between you and Narek Manukyan, a sole proprietor (individual entrepreneur) registered in Armenia ("Allby", "we", "us"), for using the Allby app and website. We've kept them as plain as we can. Please read them.

1Acceptance

By downloading, accessing or using Allby, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

2Eligibility

You must be at least 16 years old to use Allby. Allby is not directed to children, and it is not intended for anyone under this age. By using Allby, you confirm that you meet this requirement and that you can enter into this agreement. If you use Allby on behalf of a household or family, you are responsible for everyone who uses it through your account.

3The service

Allby helps you track your dog's health, activity, nutrition and care, and offers an AI care assistant. We're always improving the app, so features may change, be added, or be removed, and we may occasionally need to pause or discontinue parts of the service.

4Your account

You're responsible for keeping your sign-in credentials safe and for activity that happens under your account. Please let us know promptly if you think someone else has accessed it.

5Your content

The records you add, like your dog's profile, health, activity, meals and notes, are yours. You keep ownership of them.

To run Allby, you give us a worldwide, royalty-free, non-exclusive licence to store, copy, process and display that content, only for the purposes of operating, securing, supporting and improving the service, and only as described in our Privacy Policy. This licence lets us work with the hosting and technology providers who help us run Allby. It ends when you delete the content or close your account, except for backups we keep for a limited time or records we must keep by law.

We do not claim ownership of your data, we do not sell it, and we do not use the content of your dog's records to train AI models.

6Subscriptions & payments

Allby's core features are free. Allby Premium is an optional paid plan.

• What you get: Allby Premium unlocks unlimited dogs, your full history, the unlimited AI care assistant, and deeper trends with data export.
• Options and price: Allby Premium is offered as a weekly, a monthly and an annual subscription. Current prices are USD 4.99 per week, USD 7.99 per month and USD 39.99 per year. The price shown to you in the app for your region and currency at the time of purchase is the one that applies.
• How you are billed: When you subscribe through the app, payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Automatic renewal: Your subscription renews automatically for the same period at the then-current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Managing or cancelling: You can manage your subscription and turn off auto-renew at any time in your Apple ID or Google Play account settings after purchase. Cancelling stops the next renewal. Your Premium access continues until the end of the period you have already paid for, and then your account returns to the free version.
• Free trials or offers: If we offer a free or discounted trial, any unused part of the trial is forfeited when you buy a subscription, where the law allows. Unless you cancel at least 24 hours before a trial ends, the trial rolls into a paid subscription at the price shown.
• Price changes: If the price changes, we will give you notice as required, and where the law requires it, ask for your agreement. The new price applies from your next renewal. If you do not agree, you can cancel before it takes effect.
• Refunds: Purchases made through the App Store or Google Play are handled by Apple or Google under their own policies, and we do not process those refunds directly. To ask for a refund, use Apple's "Report a Problem" page or the Google Play refund process. For any billing question, contact narek@zoel.io.

Your use of Allby Premium is also governed by these Terms and our Privacy Policy.

7Your right to cancel (EU and UK consumers)

If you are a consumer in the EU or the UK, you normally have 14 days to withdraw from a purchase of digital content or services, starting the day you buy it.

Because Allby Premium gives you immediate access to paid features, by subscribing you ask us to start providing the service straight away and you agree that: for digital content supplied at once, you lose your right to withdraw once we begin; and for the subscription service, if you withdraw within 14 days you may be charged a fair amount for the part you have already used.

This does not affect any stronger rights the app store gives you, or any rights you have under your local law. To exercise a right to cancel with us directly, contact narek@zoel.io.

8AI care assistant

Allby includes an AI care assistant that can answer questions and offer general information about dog care. Please keep this in mind:

• The assistant is for general information only. It is not veterinary advice, and it is not a diagnosis, treatment plan, or prescription.
• Its answers are generated by AI. They can be wrong, incomplete, or out of date, and it can sometimes produce confident answers that are simply not correct.
• It is not a substitute for a qualified vet who knows your dog. You are responsible for any decision you make based on what the assistant says.
• Never rely on the assistant for an emergency, for medication or dosing, or for anything urgent. In an emergency, contact a vet or an emergency animal service immediately.

To the fullest extent the law allows, we give no warranty about the accuracy, reliability, completeness or fitness of anything the assistant produces, and we are not responsible for decisions made in reliance on it. Nothing here removes any liability we cannot exclude by law (see Limitation of liability).

9Acceptable use

Please use Allby fairly. You agree not to misuse the service, including not to: reverse-engineer or tamper with the app, scrape or harvest data, disrupt or overload our systems, or use Allby for anything unlawful.

10Intellectual property

Allby, including its name, design, software and content other than your data, is owned by Narek Manukyan and protected by law. We grant you a limited, personal, non-transferable licence to use the app for its intended purpose. All rights we don't expressly grant are reserved.

11Disclaimers

Allby is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent the law allows. We do not guarantee that the app will always be available, uninterrupted, error-free, secure, or fit for a particular purpose, or that it will meet your specific needs.

If you are a consumer, you have legal rights that these Terms do not take away. Nothing in these Terms affects your statutory rights, including any right to a service carried out with reasonable care and skill.

12Limitation of liability

Nothing in these Terms limits or excludes our liability for anything that cannot be limited or excluded by law. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, and for any statutory rights you have as a consumer that cannot be waived.

Subject to that, and to the fullest extent the law allows:

• Allby, meaning Narek Manukyan and any affiliates, and their officers, employees, suppliers and licensors, will not be liable for any indirect, incidental, special or consequential loss, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the app.
• Our total liability to you for all claims connected with Allby in any 12-month period will not exceed the greater of the amount you paid us for Allby Premium in that period, or USD 50.

Some jurisdictions do not allow some of these limits, so parts of this section may not apply to you. In that case our liability is limited to the smallest amount the law allows.

13Indemnity

If you use Allby in a way that is unlawful, that infringes someone else's rights, or that seriously breaches these Terms, and that causes a third party to bring a claim against us, you agree to be responsible for the reasonable, direct and foreseeable losses and costs we incur from that claim, to the extent it was caused by what you did. This does not apply to anything that was our fault, and nothing in this section takes away rights you have as a consumer. If you are a consumer, this obligation is limited to claims that arise from your deliberate misuse or unlawful use of Allby.

14Termination

You can stop using Allby and delete your account at any time from within the app. We may suspend or end your access if you breach these Terms or misuse the service, and where it is fair to do so we will give you notice. When your account ends, we handle your data as described in our Privacy Policy.

The sections that by their nature should continue, including Your content, Intellectual property, Disclaimers, Limitation of liability, Indemnity, Governing law, and this sentence, survive the end of these Terms.

15App stores (Apple and Google)

You may download Allby from the Apple App Store or Google Play, and your use is also subject to their rules.

These Terms are between you and us, not Apple or Google. Narek Manukyan, not Apple or Google, is responsible for Allby and its content. Apple and Google have no obligation to provide any support or maintenance for Allby.

Licence scope. The licence we grant you to use Allby on Apple devices is limited to a non-transferable licence to use Allby on any Apple-branded product that you own or control, as allowed by the App Store Terms of Service.

Warranty. If Allby fails to meet any warranty that cannot be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent allowed by law, Apple has no other warranty obligation for Allby, and any other claims relating to Allby are our responsibility, not Apple's.

Claims. We, not Apple or Google, are responsible for addressing any claims relating to Allby, including product liability claims, claims that Allby fails to meet a legal or regulatory requirement, consumer protection claims, and claims that Allby infringes a third party's intellectual property rights.

Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

Third-party beneficiary. You agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. The same applies to Google where Google's terms require it.

16General

Severability. If any part of these Terms is found to be unenforceable, the rest stays in effect, and the unenforceable part will apply to the smallest extent needed to keep the rest valid.

Entire agreement. These Terms, together with our Privacy Policy and any purchase terms shown in the app, are the whole agreement between you and us about Allby. This does not exclude any liability for statements we made fraudulently.

Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours, for example if our business is sold or reorganised, and we will not reduce your rights by doing so.

Events outside our control. We are not responsible for failing to provide, or delays in providing, Allby caused by events beyond our reasonable control, such as outages, network failures, or acts of nature.

Third-party services. Allby works with third-party services, including the app stores, hosting, and technology providers, and may link to other services such as Allby for Clinics. We are not responsible for third-party services, and your use of them is subject to their own terms.

Feedback. If you send us ideas or suggestions, you give us a free, perpetual licence to use them to improve Allby, with no obligation to you.

Notices. We may contact you in the app or by email. You can contact us at the addresses in the Contact section.

Export and sanctions. You agree to use Allby only in line with applicable export control and sanctions laws.

17Governing law & disputes

These Terms are governed by the laws of the Republic of Armenia, and the courts of Armenia will have non-exclusive jurisdiction over any dispute.

If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, and you may be able to bring a claim in your local courts. Nothing in this section limits those rights.

18Changes

We may update these Terms from time to time. When we do, we will post the new version here and update the "last updated" date. If a change is significant, for example one that affects your rights or the price you pay, we will give you reasonable notice in the app or by email before it takes effect, and where the law requires it we will ask for your agreement or give you the right to cancel. For other changes, continuing to use Allby after the update means you accept the new Terms.
